ABASmart - Terms & Conditions

These Terms and Conditions (“Terms”) govern the access and use of the ABASmart platform (“Service”) by authorized users, including administrators, supervisors, analysts, RBTs, and other professional personnel (“You”). By accessing or using the Service, You agree to be bound by these Terms.
1. Interpretation and Definitions
- Account: A unique account created for You to access the Service.
- Company: ABASmart.
- Device: Any device used to access the Service.
- Service: The ABASmart platform.
- Website: https://abasmart.net
- You: An authorized user accessing the Service in a professional capacity.
2. Acceptance of Terms
Your use of the Service is conditioned on Your acceptance of these Terms and our Privacy Policy. If You do not agree, do not use the Service.
You must be 18 years or older to use ABASmart. No accounts are issued to minors.
3. Authorized Use
You agree to:
- Use the Service only for lawful, professional, and authorized purposes.
- Keep Your login credentials **confidential.**
- Avoid sharing access with unauthorized individuals.
- Maintain the security of any devices used to access the platform.
You agree **NOT** to:
- Misuse, manipulate, or disrupt the Service.
- Attempt unauthorized access or reverse-engineer the platform.
- Upload malicious code or harmful content.
- Use the Service for personal, non-professional, or **prohibited purposes.**
4. Access Termination
We may suspend or terminate access immediately if:
- You violate these Terms.
- Security risks or **unauthorized activity** are detected.
- Required by law or contractual obligations.
Upon termination, access to the Service ceases immediately.
5. Links to Third-Party Services
The Service may include links to external websites not controlled by ABASmart. We are not responsible for the content, policies, or services of third parties.
6. Limitation of Liability
To the maximum extent permitted by law:
- ABASmart is not liable for indirect, incidental, consequential, or special damages.
- ABASmart’s total liability shall not exceed the amount paid for the Service in the last 12 months or $100 if no payment was made.
7. “AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided without warranties of any kind. We do not guarantee:
- That the Service will be error-free or uninterrupted.
- Accuracy or reliability of information.
- Compatibility with all systems or devices.
8. Compliance and U.S. Legal Requirements
You warrant that You are not:
- Located in embargoed or restricted countries.
- Listed on U.S. government restricted-party lists.
9. Severability
If any provision of these Terms is found invalid, the remaining provisions remain enforceable.
10. Waiver
Failure to enforce a right or provision does not constitute a waiver of that right.
11. SMS Messaging Terms
a. Program Description
By opting into SMS communications from ABASmart, you agree to receive text messages regarding your account security (Two-Factor Authentication), login verification, and important system alerts.
b. Cancellation
You can cancel the SMS service at any time. Just text "STOP" to the short code or number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or contact support.
c. Help
If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at contact@abasmart.net.
d. Carriers
Carriers are not liable for delayed or undelivered messages.
e. Cost and Frequency
As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your login activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
f. Privacy
If you have any questions regarding privacy, please read our privacy policy. Your phone number and consent will never be sold or shared with third parties for marketing purposes.
12. Changes to These Terms
We may modify these Terms at any time. If changes are material, we will notify users at least 30 days before they take effect. Continued use of the Service indicates acceptance.
